The Long Road to Michigan Online Sports Betting

PASPA

The Professional and Amateur Sports Protection Act, or PASPA for short, was approved in 1992. As a result, sports betting in the United States was effectively banned (with some exceptions). For nearly 30 years, PASPA served as a wall separating states from legal sports betting. But no more.

On May 14, 2018, the Supreme Court officially struck down PASPA, opening the door for states to pursue their own legal sports betting options individually.

2018: Close, But No Cigar

2018 seemed like it would be the year that Michigan would finally pass an online sports betting bill. In the final hours of the 2018 legislative year, Rep. Brandt Iden finally put the "Legal Internet Gambling Act" to a vote. H4926, which legalizes online poker, casino games, and slots, and lays the groundwork for sports betting, easily passed the Senate by a 33-5 vote. The bill quickly moved to the House, where it easily passed 71-35 three hours later.

The only thing standing in the way of legal, safe, and regulated online gaming was the signature of lame-duck Governor Rick Snyder. In his final act in office, Governor Snyder vetoed H4926. With that veto, online sports betting and casino gaming are gone for good at the end of 2018.

The Lawful Sports Betting Act

Led by Rep. Brandt Iden, Michigan lawmakers decided to rework the bill once more in 2019. After successful negotiations over taxes and fees, the "Legal Sports Betting Act" was born. Michigan sports betting apps and websites appeared.

HB 4916, the Legal Sports Betting Act, was passed on December 11, 2019, as part of a larger iGaming bill that also included casinos and poker. It sets Michigan's sports betting tax at 8. 4%, a competitive rate within the industry. The tax revenue goes to the state's school aid fund.

Potential sports betting operators must pay a license application fee of $50, 000, $100, 000 if the actual license is approved, and then a $50, 000 annual renewal fee.

Michigan also requires official league data, similar to legal sports betting in Illinois and Tennessee.

Michigan’s Betting History

Until 1972, horse racing was the only gambling form in Michigan, but the form changed when charity gambling and lottery were added. In the early 1980s, Native American tribes began to provide hig h-priced bingo holes and became extremely popular. The tribe has negotiated with the state for class two gaming licenses that allow you to provide electronic bingo and lottery games. There was a legal struggle, but eventually the state allowed a license.

While the three commercial casinos of Detroit prospered, the native American tribes felt neglected and tried to participate in their activities. After a number of court struggles, they were eventually contested in front of the Supreme Supreme Court, resulting in a license to provide table games and slots. Currently, there are more than 20 casinos operated by 12 tribes.

In 1999, the state, feared that online gambling would take income from Detroit's new casino, passed a law that banned all forms of online gambling. However, the law was withdrawn at the end of the same year.
