California voters still oppose sports betting initiatives

Last year, after a California voter rejected two sports betting bills, a new opinion poll will continue to oppose voters next year.

California Tribes reject new sports betting proposal

California sports betting initiative qualifies for Nov 8, 2022 ballot

A ballot measure entitled "California Initiative to Legalize Sports Betting on American Indian Lands" has qualified for appearance on the November 8, 2022, election ballot. If passed by voters, it would amend the state constitution and current law, making the following changes:

New California Indian casinos possible after federal court ruling

The case was filed in 2019 by five California tribes trying to renegotiate their gaming agreements with the state. U. S. District Judge Anthony Ishii in Fresno said state negotiators "crossed the line" by demanding tribes accept California's policies on child support, spousal support, discrimination, personal injury cases and construction projects.

The judge said the state's demands were outside the scope of the American Indian Gaming Regulatory Act.

"By limiting the appropriate topics for compact negotiations to those directly related to the operation of gaming activities, Congress intended to prevent the compact from being used as a ploy to impose state jurisdiction on tribes over matters unrelated to gaming." - U. California Indian Casinos remain open during COVID-19 stay-at-home order

Calif Tribes Lose Lawsuit for Card Game Exclusivity

Following the ruling, the California Gaming Association announced the following press release today.

Plaintiffs (tribes) argued that the recently concluded agreement guarantees the same monopoly rights as negotiated in the 1999 agreement. The court does not agree with this. The agreement acknowledges the exclusive rights determined by the California Constitution, but does not include a specific clause on the duty to maintain that right. In fact, the agreement assumes that the rights are destroyed, and the tribes can receive limited relief if exclusive rights are expired. (8 pages 12-20 lines)

The plaintiff's assertion must indicate that the agreement has led to an obligation to adopt the state of the plaintiff's "banking and percentage card game". There is nothing in the agreement that suggests such obligations. In fact, the plaintiff's own complaint denies the idea that the provisions of the agreement are based on how the defendant interpretes and executes the state law. (Page 11, line 22-28)

The plaintiff's assertion must indicate that the agreement has been stated that the agreement has led to the obligation to adopt the definition of the plaintiff (tribal) of "banking and percentage card games". There is no such obligation in the agreement. (Pages 11 to 25 lines)
