Dutch online gambling license – application procedure update

This blog explains the license application procedure to the Netherlands Gaming Authority (Ksa) and provides information on games permitted under the Dutch Distance Gambling Act. The Netherlands Gambling Authority (Ksa) is the authority that processes applications for online gaming licenses under the Distance Gambling Act (Koa). Applications must be made in Dutch.

Four remote games of chance will be allowed in the Netherlands:

a. Casino games in which players play against licensees;

b. Casino games in which players play against each other;

c. Betting on events during sporting events or on the outcome of sporting events;

d. Betting on the outcome of horse and harness races.

For lotteries, the existing application procedure is available. Foreign lotteries that are eligible to host lotteries in the Netherlands can obtain a Dutch license on an equal footing with Dutch licensees and can use the Internet as a sales channel.

Method of application for Dutch remote gaming licences

Applications are submitted in Dutch and in digital form. The application costs approximately 45, 000 euros. This amount is not refundable if a license is not granted. Applications will only be processed if the application is complete, the applicant's identity is clear and payment has been made. In some cases, the applicant may be asked to upload supporting documents. Note: Please keep the information as concise as possible. See also requirements for foreign applicants here.

The KSA license application form has seven parts ("modules"). The main points for each part are as follows:

This part requests information, among other things, on assets, liabilities, involvement in other companies, group structure and organizational chart. More information on the due diligence procedure in the Netherlands can be found here.

Part E-Consumer Protection

This part covers marketing and advertising, information and education, complaint processing, preventing addiction, and identification of players. It is required to provide insights to prevent it.

  4. Licensee organizes its business operation (gaming system) based on Article 31H, Paragraph 1 (WOK), which is responsible, reliable, verified and verified. I have to do it. Since the remote gambling and fac e-t o-face gambling have a close correlation, this article of the remote gambling regulations also includes the technical and operation requirements of the gambling system.
  5. Paragraph 1
  6. The range of games of chance that can be organized remotely is very wide, diverse and constantly changing. It is impossible to create uniform rules for each game of chance and maintain them in line with the development of practice. The regulation of licensed games of chance is therefore based on the characteristics of the games of chance and the associated risks for a responsible, reliable and verifiable organization. Four types of games of chance are distinguished:
  7. a. casino games in which players play against licensees;
  8. b. casino games in which players play against each other
  9. c. sports betting
  10. d. betting on the outcome of horse and harness races.
  11. In addition to games of chance organized as classic table games casinos, casino games also include slot machine games organized remotely. It is important that at least the popular casino games (including roulette, blackjack, baccarat, sic bo, money wheel, poker, 50-ball, 70-ball and 90-ball bingo) and remote slot machine games are offered. It is impossible to predict what games of chance will be developed in the future and what games will be in high demand. It is important to have flexibility in how the supply of games is regulated so that licensees can deploy an adequate supply. This allows them to adapt their supply to changes in the demand of Dutch players.
  12. Casino games in which players play against licensees (jeux de contrepartie) include almost all games currently played in Dutch casinos: casino table games (poker is an important exception) and games of chance played on slot machines. The determination of the odds is almost entirely controlled by random generators. Games of chance have no inherent elements that slow down the pace of play, such as interaction between players or waiting for sports results, so the speed of the game is a risk for this category.
  13. Casino games played against each other (jeux de cercle) include most forms of poker and 75-ball, 80-ball and 90-ball bingo formats. The role of the licensee is purely facilitative. Probability determination is controlled by random generators, differences in player skill and group dynamics between players. This category of games of chance also involves risks such as cooperation between different players that reduces the chances of other players winning, money laundering through transactions between players and self-overestimation on the part of players that (allegedly) influence the outcome of games of chance.
  14. In accordance with the Dutch Media Act 2008, a sports competition is defined in article 1. 1 as a competition organised by or held under the auspices of a national sports organisation recognised by the NOC*NSF and its affiliates, or of a comparable international sports organisation, whether or not an affiliated organisation, or of any other sports competition designated as a sport by the NOC*NSF.
  15. In practice, sports betting is organised in different ways. For example, fixed odds betting, pool betting, betting exchange, spread betting, etc. In fixed odds betting, the provider itself determines the odds (ratings) for fixed odds bets and allows players to place their bets. The rating determines the amount that will be paid if the player places the bet and wins. The bookmaker sets the fixed odds before the match. Such bets are currently offered in the form of toto in the Netherlands.
  16. In exchange betting, the provider offers a marketplace comparable to a stock exchange where buyers and sellers can trade with each other. Exchange betting providers do not decide the prices themselves, it is left to the supply and demand on the relevant exchange market. For each bet that players place with each other, the provider receives a commission. In pool betting, the provider collects all the bets on a sporting event. The provider receives a percentage of this. The remainder becomes the total pot that is paid to the winners.
  17. With spread betting, players are exposed to the risk of losing an amount higher than their stake because ratings are not set before participation and odds are not determined until the end of the game. As a result, players’ financial risk is unpredictable.
  18. Many chance games must not be organized. This is especially applied to casino games and sports beds (spread beds), which is organized in a way that could be more than the amount of money actually bet. (A (sports) bet is also prohibited for games that are unacceptable to the risk of operation. The feature of sports betting is that the result of a coincidence is not determined by an accidental device, but the result of the sports game. Or the risk is determined by the event of sports, as long as the betting (including the 80 0-match) of the betting (including the matchmaker), the betting arranged by the player. There is money laundering.
  19. Horse racing and harness races are treated separately because they are not sports competition defined in Article 1, Paragraph 1 of this decision. The risk includes the operation of the match result. Beds for this kind of match are allowed to be organized by the Netherlands Horse Racing Association (NDR) or as equivalent to the domestic or international organization (whether or not the umbrella). In horse racing and harness racing, you can bet only on the results.
  20. Based on the license for organizing remote gambling, in principle, all casino games (players play a license holder or play with players), all sports beds, and trot racing in remote areas All bets can be organized. This assumes that these chance games and their organizational methods meet the requirements included in the rules of the main government and remote chance game. < SPAN> Many chance games must not be organized.
