ESPN BET’s New York Sports Betting Launch Delayed by Regulatory Roadblock

The hold is tied to PENN's entry into the Empire State, namely its acquisition of a Wynn Resorts affiliate that holds the New York online sports betting license.

ESPN's official sportsbook is stuck waiting for the green light from regulators to launch in the Empire State.

PENN Entertainment Inc. last month hinted at the possibility of launching ESPN BET in New York by late August. But a press release warned that "regulatory approvals are required."

As it turns out, PENN has yet to secure all those regulatory approvals, meaning ESPN BET is not up and running in New York, the largest legal sports betting competitive market in the United States.

Waiting is the hardest part

The issue revolves around Wyoming, Pennsylvania-based PENN's entry into the Empire State, specifically its acquisition of a company affiliated with Wynn Resorts, which holds the New York online sports betting license.

A New York State Gaming Commission (NYSGC) spokesperson told Covers on Monday that PENN's application to acquire Wynn has not yet been considered by the regulator's board of directors.

"We expect this item to be on the agenda at the next commission meeting scheduled for September 23, 2024," NYSGC communications director Brad Maione said in an email.

Maione also confirmed that the commission's board of directors must approve the PENN acquisition before ESPN BET can launch New York sports betting. That could keep the bookmaker on the sidelines until the end of this month, or beyond if there are further delays.

"PENN Entertainment is working closely with the New York State Gaming Commission and plans to launch ESPN BET in New York if final approval is granted.

PENN announced in February that it had inked a deal with Wynn Interactive Holdings that included the acquisition of the company that holds the online sports betting license to be issued by the NYSGC in 2021. WynnBET had obtained the license before shutting down operations in New York and several other markets.

The Wynn deal was crucial for PENN, as PENN agreed last year to pay ESPN $1. 5 billion in cash over 10 years for exclusive rights to the ESPN BET brand. PENN was obligated to pay that money even if it was forced out of the huge New York market.

"This is a significant development that brings ESPN BET to the largest online sports betting market in North America," PENN CEO and President Jay Snowden said in a press release earlier this year.

PENN announced in February that ESPN BET would launch in New York in 2024, subject to regulatory approval. Snowden then said in an August earnings press release that the company would "maintain a disciplined approach to customer engagement as we launch ESPN BET in New York in late August."

The "late August" timing suggested it could be in time for the start of the NFL regular season. But that time has come and gone, and ESPN BET is still waiting for final sign-off from state regulators.

Unlike Wynn Interactive, PENN was not the winner of a competitive bidding process for New York's online sports betting license. And while ESPN BET is available in 18 other states, it's been fighting to gain a foothold in the online sports betting market and beyond. Its launch in New York will help boost those efforts.

Top of the heap

The operator, which first launched in November 2023, accounted for 1. 7% of total gaming revenue generated in July in 11 states, including New York, according to a Citizens JMP Securities note. But ESPN BET's market share is paltry compared to DraftKings' 37. 8% and FanDuel's 40. 1% GGR leads.

"ESPN BET's aggressive expansion into the U. S. market over the past few months has not prevented Flutter's FanDuel brand from growing market share or EBITDA margins," Morningstar senior equity analyst Dan Wasiolek wrote in a note earlier this month.

However, excluding New York, ESPN BET's market share grew to 2. 8% in July, according to JMP calculations. This suggests that the operator has upside if and when it can get its act together in the Empire State.

PENN said in its second-quarter presentation to investors that a New York launch would give ESPN BET access to a market that represents 46% of the U. S. population, up from 40% today.

"Subject to regulatory approval, launching in New York would significantly expand our digital footprint and further leverage ESPN's unmatched sports media reach.
