A Type 1 or Type 2 license or approval may be revoked if it is discovered that the applicant provided false or inaccurate information at the time the license or approval was granted, which would have resulted in the license or approval application being rejected if this had been known. In such cases, a new license application may be submitted at least five years after the date on which the decision to cancel the license or approval became final in the administrative appeal system or the date on which the court's decision became final. The National Gambling Authority shall revoke class 1 or class 2 licenses depending on the consequences of the violations in the following cases: (i) failure to comply with payment obligations to the Romanian State Budget or to pay the respective obligations without delay; (ii) if the operator no longer has the organization of games of chance as its main object of activity/business scope; (iii) if a conviction without rehabilitation is established against the operator; (iv) if a shareholder or legal representative of the operator has maintained his/her position for more than 30 days after a final conviction without rehabilitation has been established in Romania or a foreign jurisdiction for a crime provided for in the Romanian Gambling Law or for any other crime committed with intent, which carries a minimum sentence of two years imprisonment.
After the revocation of the license, a new application can be submitted only after at least one year has elapsed since the date on which the decision to revoke became final.
If a gambling operator wishes to cease its activities before the expiration of the license and related authorizations for organizing games of chance issued for it, the operator must notify the National Gambling Authority of this effect and at the same time pay the outstanding amount of taxes/fees related to gambling activities. In such cases, the Supervisory Committee of the National Gambling Authority will revoke the license and, as a result, declare the operating authorization to be no longer valid.
The regulator can also decide to suspend a class 1 license for other reasons, even if not expressly regulated by law, such as a violation by the operator of the terms of use or game rules, which may cause damage to players, or until the circumstances are clear.
