Gambling package suddenly emerges, then stalls in Alabama Senate

The Alabama House voted overwhelmingly for the measure. But in the Senate, a procedural rule may have prevented its defeat.

A constitutional amendment to allow some gambling and lotteries in Alabama passed the House on Tuesday but stalled in the Senate over votes and unclear procedural rules.

The House voted 72-29 to approve the conference committee report of HB 151, a constitutional amendment to allow lotteries and limited gambling. HB 152, a bill to tax and regulate gambling, passed 70-29.

But then the Senate voted 20-15 to pass HB 151, one vote short of the three-fifths majority needed to pass the constitutional amendment. This seemed to kill the bill, but a second vote was called and the conference committee report was passed.

Senate Deputy Secretary Pat Harris told reporters that conference committee reports are items, so they require a majority vote to pass. But because HB 151 is a constitutional amendment, it requires a second vote, which would require at least 21 votes to pass.

The Senate's 20-15 vote met the requirement to adopt the committee report by a majority vote, but the Senate held up the bill before a second vote to approve it as a constitutional amendment.

The bill can be taken out of the basket at a later date and is still alive.

Harris said that this is the only other time in the 128th session that a constitutional conference committee report has been voted on twice.

Senate President Pro Tem Greg Reed of Jasper said it was a "test vote."

Sudden breakthrough

The vote came just hours after a conference committee suddenly broke a weeks-long stalemate over the bill in the Alabama House and Senate.

"The Alabama Education Lottery would allow for paper-only drawings," said bill sponsor Rep. Chris Blackshear (R-Smiths Station) during a conference committee meeting Tuesday afternoon.
