The Nebraska Supreme Court ruled Friday that competing measures to expand or restrict abortion rights can appear on the November ballot.

The high court's ruling came days after hearing arguments in three lawsuits that sought to remove one or both of the competing abortion initiatives from the November ballot. Organizers in each case submitted more than 200, 000 signatures, far more than the 123, 000 required to qualify for the ballot. Organizers of the measure to expand abortion rights called the decision a "victory for all Nebraskans."

"Anti-abortion politicians tried to ram through the abortion ban and then work with activists to launch desperate lawsuits to silence more than 200, 000 Nebraskans," he said. "They know Nebraskans want to repeal harmful abortion bans and stop government overreach over personal, private health care decisions. Today, their plan has failed."

Matt Heffron, an attorney for the conservative Thomas More Society, which challenged the measure to expand abortion rights, called the court's ruling "deeply disturbing" and said that if the measure passes, it would limit abortion to second and third trimesters of pregnancy. The group said it fears this could lead to unnecessary abortions in the third trimester.

The US Centers for Disease Control and Prevention reported that in 2021, fewer than 1% of abortions occurred after 21 weeks of pregnancy.

One initiative would enshrine in the Nebraska Constitution the right to abortion before viability or beyond to protect a pregnant woman's health. The other would enshrine in the Constitution Nebraska's current 12-week abortion ban, passed by the Legislature in 2023, and includes exceptions for rape, incest and the life of a pregnant woman.

The two lawsuits, brought by an Omaha resident who opposes abortion and a Nebraska neonatologist, argue that the bills that would expand abortion rights violate a state rule that prohibits a single bill or ballot measure from addressing more than one topic. They say the ballot measure addresses three separate issues: the right to abortion before viability, the right to abortion after viability to protect a woman's health, and whether the state should be allowed to regulate abortion.

"The fact that the initiative's drafters made specific choices regarding certain limitations, parameters, or definitions does not mean that each such provision is a separate subject matter," Justice Lindsay Miller-Lerman wrote in the unanimous decision.

A similar single-subject argument failed earlier this year before the conservative Florida Supreme Court on an abortion-rights ballot measure.

"We note that our decision in this case is consistent with the Florida Supreme Court's decision issued earlier this year," Friday's opinion read.

The third case challenged the 12-week ban ballot measure. If the high court finds that the abortion-rights measure fails the single-subject test, it must also find that the 12-week ban fails. Lawyers in that third case argued that the abortion-restriction measure loops in at least six separate subjects, from restricting abortion to listing exceptions for rape, incest, and maternal life.

Nebraska's high courts have taken mixed views on challenges to single-subject laws. In 2020, the Nebraska Supreme Court struck down a ballot initiative to legalize medical marijuana, ruling that provisions allowing marijuana use and marijuana production were separate subjects and violated the state's single-subject rule. One initiative would enshrine in the Nebraska Constitution the right to abortion before conception or beyond to protect the health of pregnant women. The other would enshrine in the Constitution Nebraska's current 12-week abortion ban, passed by the Legislature in 2023, and includes exceptions for rape, incest and the life of the pregnant woman.

The third case challenged the 12-week ban ballot measure. They argued that if the high court finds that the abortion-rights measure fails the single-subject test, it must also find that the 12-week ban fails. The abortion restriction bill would loop around at least six separate subjects, from regulating abortion to listing exceptions for rape, incest and the life of the mother, the lawyers for that third case argued.

In 2020, the Nebraska Supreme Court struck down a ballot initiative seeking to legalize medical marijuana, finding that provisions allowing marijuana use and marijuana production were separate subjects and violated the state's single-subject rule. However, in July, the court had a hybrid bill that combined the legislative government passed by a legislature in 2023, which combines the 1 2-week abortions and another measure to limit the gender confirmation medical care for minors must violate the single theme rules. Decided. As a result, Lindsey Mirro r-Rahman, Larnan, accused the legislature passed by a bill passed by the legislature and the bills required of the voter voting of voters, accused the majority of the majority, and commented on the majority. The court has unnecessary the hearing in the lower instance, and has agreed to conduct a lawsuit and ruling quickly to settle this problem before the ballot is printed throughout the state. The deadline for voting in November Nebraska is Friday.

Nebraska is the first state to publish abortion amendments to compete with the same ballot since the Federal Supreme Court overturned the Low vs. Wade trial in 2022. However, the topic of the abortion of artificial pregnancy will be voted in nine states in the United States this year. Arizona, Colorado, Florida, Maryland, Mizuri, Montana, Nevada, and South Dakota will also be submitted to voters to protect access to abortion.

New York has a voting bill to protect abortion rights, and the impact is controversial. Arcansaw has been attempted to add a lawsuit, although no discontinuation bills are not voted.

In Nebraska, voters may approve both competing abortion bills. However, both of them will not be able to specify both in the constitution because they compete, and will be adopted by those who have more "agree" votes. In all seven states, which have been enacted abortio n-related voting ordinances since the reversal of the Law and Wade, voters have supported the right of abortion.

Most of the Republicans dominated by the Republican Party have been implementing some discontinuation measures since the row was overturned.

Opinion polls have increased the support of abortion rights, and recent AP communication and NORC surveys make six out of 10 Americans legally abortion for some reason.
