Legend Resort & Casino Arkansaw acquired a license from the Arkansaw State Horse Racing Committee on June 27, 2024, after five years of legal challenge, invalid casino license, and second application procedure. 2020 Pope County Casino License

In the mi d-2020, the Arkansaw's Horse Racing Committee selected and approved the plan to build a Casino Partners, a casino group in Mississippi, to build a $ 254m casino resort in Russell Building, Pope County, Arkansas. The casino, named River Valley Casino Resort, has 2, 100 slot machines, 100 table games, and 600 hotel rooms.

A new casino selection application process was mandated for Pope County following the 2023 Arkansas Supreme Court decision against Pope County's selection of Legends Resort Casino Arkansas. The selection process was approved by the Arkansas Racing Commission, and the casino application was resubmitted in June 2024.

The new casino application process began on May 13, 2024. The deadline for submissions is June 11, 2024. The Arkansas Racing Commission received an application from Cherokee Nation Entertainment for Legends Resort & Casino Arkansas, an application from Gulfside Casino Partners for River Valley Casino Resort, and a letter from Churchill Downs.

There are two applicants:

Legends Resort & Casino Arkansas Russellville, Arkansas Applicant Cherokee Nation Entertainment, a subsidiary of the Cherokee Nation.

Gulfside's resolution of support was rejected by a 7-5 majority, a fatal blow to Gulfside's casino plans.

Cherokee Nation Entertainment (CNE) appears to be the leading candidate for the casino. CNE's application for Legends Resort & Casino Arkansas was filed on June 5, 2024, and is supported by a resolution of support from the Quorum Court issued in December and by Pope County Judge Ben Cross.

The Arkansas Supreme Court has denied an appeal by Legends Resort and Casino and Cherokee Nation Businesses to review a recent ruling that invalidated a casino license issued in Pope County. The license will be returned to the Arkansas Racing Commission, which will reopen the application process.

Arkansas Supreme Court Rejects Pope County Casino License Appeal

The appeal is based on a ruling by Polaski County Circuit Judge Tim Fox, who determined last year that the Racing Commission erred in awarding Pope County casino licenses to two entities (Legends Resort and Casino and Cherokee Nation Businesses). Judge Fox ruled that only one entity can hold a casino license pursuant to Amendment 100 of the Arkansas Constitution. That ruling was upheld by the Arkansas Supreme Court last October.

The next step is for the Arkansas Racing Commission to launch an entirely new bidding process for the Pope County casino license.

Last week, the Pope County Court of Quorum voted 7-6 to support the Cherokee Nation business plan to build a $225 million casino resort in Russellville. The casino, named "Legends Resort Casino," would include a casino with 1, 200 slots and 21 table games, a concert venue, an outdoor water park, a 200-room hotel, a 15, 000-square-foot conference center, and a 100-space RV park.

Arkansas Supreme Court reopens Pope County casino license process

The ruling upholds a lower court ruling made last January 12 by Pulaski County Circuit Court Judge Tim Fox, who sided with plaintiff Gulfside Casino Partnership in challenging the Arkansas Racing Commission's license for Cherokee Nation Businesses (CNB) and its plans for Legends Resort and Casino.

The Arkansas Supreme Court issued the following statement:

"The ARC issued Pope County casino licenses to both Legends and CNB. However, at the time of issuance, CNB was not in the process of applying to the ARC. As previously discussed, five applications were submitted in the May 2019 application period, but all five were denied for not meeting the requirements of Amendment 100. Since then, the ARC has not reopened another application period to consider new applications. Because CNB's only application to the ARC was submitted in May 2019 and ultimately denied, it was not a 'qualified applicant' as required by Amendment 100. The Department of Financial Management's Regulatory Division is currently reviewing the ruling and will work with the Arkansas Horse Racing Commission to reopen the application process and open a new application window.

Nearly five years have passed since Pope County was selected as one of four casino licenses authorized by Amendment 100, approved by voters in 2018. So far, nothing seems to have happened. The battle between the two casino applicants is tangled in the Arkansas Supreme Court.

Pulaski County Circuit Judge announced this week that Cherokee Nation Entertainment has partnered with Legends Resort and Casino to develop the Cherokee Nation Casino. The judge ruled that the Arkansas Racing Commission's decision to issue a casino license to Cherokee Nation's Pope County was unconstitutional and invalid.

Legends was sued by Gulfside Casino Partnership, which had originally applied for the license. Gulfside has been fighting for four years to build a $254M casino resort in Russellville, called River Valley Casino Resort.

Cherokee Nation Appeals after Judge Voids Pope County Casino License

The judge ruled that Legends' license was invalid because Legends does not have the casino gaming experience required by Section 4 of Amendment 100.
