Provisions of treaty and agreement proposed by the commissioners of the United States in pursuance of a request made by a delegation representing the Chickasaw Nation of Indians.
ART. I.
Peace and friendship.
It is agreed that there will be a perpetual state of amity, peace and friendship between the United States and the Chickasaw Nation of Indians.
ART. II.
The Indians who are to be removed will be protected by the United States.
The Chickasaws are about to abandon the homeland which they have long cherished and loved. They hope, so far unsuccessfully, to find somewhere west of the Mississippi River, within the territory of the United States, a country sufficient for the wants and support of their people. If this should happen, the United States Government agrees to protect and defend them against the incursions of other Indian tribes and from the whites, and agrees to maintain them without any State or territorial restrictions. The Chickasaws pledge not to wage war against any Indian tribe or whites unless authorized by the United States. But if war should be made against them, they shall be allowed to defend themselves until assistance is given them by the United States.
ART. III.
The United States shall prevent any incursion upon their lands.
The Chickasaws are ignorant of the laws of the white man which prevail over them; and many intruders who invade their country, to hinder their rights and disturb their rest, leave them no other choice for restraining them than to resort to the military force of the state; they therefore agree to refrain from such requests, in order to prevent this great evil; and the agents of the United States agree, at the request of the chief, to use (at the expense of the United States) all lawful civil remedies to prevent intrusions into the ceded lands, and at the request of the owners of selected reservations, to restrain and remove the intruders therefrom; and the United States agree to retain as agents several prudent persons, who may seek redress for any wrong or injury which may be attempted against them, as they now have in the United States; and, if any person of the United States should stealthily or forcibly remove any property of the United States, the agents, on satisfactory and just complaint, shall use all lawful civil means permitted by the laws of the state in which the wrong was committed, to recover said property, or obtain a just reward.
ART. IV.
By what authority may the reservations be sold?
The Chickasaw Nation desires to have the means of caring for itself under its own direction and control. It therefore agrees that it will not permit the reservation to be sold, rented, or otherwise disposed of, without a certificate from at least two of the following persons: Ish-ta-ho-ta-pa the King, Levi Colbert, George Colbert, Martin Colbert, Isaac Alverson, Henry Love, and Benji Love, who are named in this treaty, that the owner or claimant is able to manage and care for his affairs, which fact shall be certified by the agent to the best of his knowledge; This instrument and approval shall be registered in such place and within such time as the law of the state in which the land is situated may require. In the event that such certificate is not obtained, the land may be sold, at the discretion of the President of the United States, by the recommendation of a majority of the delegates and the approval of the agent. ART. V.

ART. VI.
If the agent determines that the land is unsuitable for cultivation and three of the seven persons mentioned in article 4 above have a right, the person who has the right may claim it on another piece of land;

ART. XVI.
