2020 Preview: Virginia Casino Legalization?

Governor Ralph Northam supports the expansion of gaming in Virginia, but did not sign the gaming bill sent to him by the Legislature. Instead, he amended the bill and sent it back to the Legislature to reconsider.

A key provision that the Governor amended is the distribution of gaming revenues the state receives. Instead of designating the revenues to the Virginia General Fund as provided in the bill, the Governor wants to send two-thirds to the state's education programs.

The Legislature will now reconvene on the issue to finalize the bill. If the Governor's changes are approved, the bill will become law. If it is rejected or no action is taken, the Governor has the final decision to sign or veto the bill.

One of the hot topics in the Virginia General Assembly in 2020 is casino gambling. Virginia is currently one of nine states that ban casinos.

In March 2019, the state legislature passed a casino bill and the governor signed it in five cities: Bristol, Danville, Richmond, Norfolk, and Portsmouth.

The Legislature also ordered a study by the Joint Legislative Audit and Review Committee (JLARC) to examine the impact of casinos on these areas. The findings of the JLARC report are as follows:

The new law is not the final authorization needed to build a casino. Final authorization can only be granted by voters in a November 2020 referendum.

Between now and the referendum, additional steps are defined that will be the responsibility of the Lottery Commission. The law gives the Lottery Commission the authority to regulate all casino gaming and provides a framework for the commission to follow when drafting policies, rules and procedures.

Virginia tribes celebrate federal recognition

Today, the Virginia Congress has legally legalized casino gambling in Virginia and has given the Virginia Lottery Committee to give regulations.

The bill passed the Senate 30 to 10 and the House of Representatives 64-33. The bill is required to be settled by voters to approve the governor's signature and the state constitutional revision.

With the provisions of the bill, the Virginia Lottery Committee shall formulate rules and regulations on casino gambling, and a license giving procedure to casino applicants. The rules must be completed by June 30, 2020 and must be approved. The casino license will be issued after July 1, 2020.

The bill specifies five cities that can build a casino: Bristol, Danville, Portsmouth, no Fork or Richmond. Residents must vote for casinos planned in the city. The referendum must be passed by January 1, 2021.

The state taxes 13 to 15 % of the total annual coordinated income for each casino.

The Senate General Laws and Technology Committee passed Senate Bill 1126 by a 9-3 vote, the first major step toward legalizing casinos in Virginia.

The bill would allow five cities to hold referendums this fall to ask voters for or against casino plans in their cities. The five cities are Danville, Bristol, Portsmouth, Norfolk and Richmond. Casino licenses would be issued starting July 1, 2020.
