Welcome to Curaçao: How a Caribbean island facilitates the illegal betting boom

Brazil has become the Wild West of betting. Droves of offshore betting companies have set up shop in the country with flimsy sub-licenses from Curaçao that do not give any protection to bettors. Politicians in both Brazil and Curaçao are struggling to reform and regulate the betting market.

In November 2023, on the last day of the Rio de Janeiro Championship Division B, San Cristovan welcomed FC Rio Sao Paulo. The two teams did not win, and the away team was lined up with 10 players because there were no other players. At the beginning of the second half, FC Rio Sao Sao Paulo had nine players dragged their feet with convulsions.

However, in the reporter, the local sports reporter group Acerj (Associação Cronistas Esportivos Rio Janeiro) certified data companies Genius Sports and Stats Perform data collected all game data. Anxiously, major sports data integrity companies did not judge that the match was suspicious. The game was provided in Impure on Betano and Pixbet in Brazilian Betting Sites, and overseas, 1XBET in Spain and Ghana 1XRAJA. com.

Brazil is a betting wild west. With no appropriate regulations in Japan, offshore betting companies rushed to Brazil.

In Curaceau, where the identity of the betting operator is secretly wrapped, there are Malta licenses and the licensed license.

These international licenses do not need to disclose the ultimate real owner of the betting company. There is no obligation to report a suspicious betting signaling matchfixing, and there is almost no remedy for Betters.

Brazilian lawyers have been swayed by offshore operators who claim to be allowed to operate by such a "license" and have been delayed, but they have created a legal framework that suppresses the worst of the betting industry. It's starting to move.

However, the blow to Brazil has also hit other countries who have not been ready for the offshore betting operator's invasion of the Internet looking for a frontier without restrictions.

Betting is everywhere on the streets of Brazil

In 2018, the Brazilian legislation showed the full ban on all the gambling, which has been imposed by the Geturio Valgas and Eulico Gaspard administration in the 1940s for decades.

Law 13, 756 has legalized "fixed odds sports betting" for four years to provide the Ministry of Economy to regulate the industry and issue a license.

However, due to religious beliefs, evangelical backers delayed the introduction of the proposed law through Congress and the Senate. As a result, sports betting remained in a gray area in Brazil between 2018 and 2023.

In the absence of federal regulation, offshore betting operators flooded the market, despite the theoretical risk of criminal persecution. It is estimated that more than 1, 000 betting operators are active and eager to take advantage of the fast-growing market.

Betting is everywhere on Brazilian street corners. Rio de Janeiro is a perfect example of the ubiquity of betting ads trying to get Brazilians to place bets.

On the world-famous Ipanema Beach, sports planes fly by with banners of sports betting operators Esportes da Sorte and Rivalry. bet, promising 210% bonuses.

Sportingbet, official sponsor of the Copa Libertadores, South America's top club tournament, advertises in newspaper dealerships. On buses, Aposta Ganha advertises with the slogan "Play for fun." On the subway, BestBet touts itself as the "most reliable" and promises a bonus of up to 500 reals (93 euros) upon registration.

At Maracana subway station, the word "Betano" is plastered all over the columns that support the station's structure. Betano is the title sponsor of the Rio de Janeiro State Championship, and the Malta-based operator's name is also on match tickets. 1XBet also appears on advertising billboards when the Brazilian national team plays.

Close to 40 per cent of the population over 15 are betting

Online sports betting in Brazil is exploding, with betting sites recording a total of 2. 1 billion visits and 64. 1 million unique visitors between September and November 2023, according to Similarweb, which measures website traffic.

The 64. 1 million figure represents 38% of Brazil's male and female population aged 15 and over. In November 2023, 66 percent of these visitors were concentrated on just 1% of websites in the industry, and Brazilians spent more than $11 billion on online betting in 2023.

From the Armenian Table Tennis Festival at 1XBet Brasil to São Cristóvão-Fc Rio São Paulo at Esportes da Sorte to the Indonesia U-17 World Cup on a huge number of websites.

Betting brands are promoting themselves as Brazilian. VietNacional's slogan, "The Brazilian Bet," is displayed alongside a smiling image of brand ambassador and Real Madrid star Vinicius Jr.

Meanwhile, famous TV commentator Garban Bueno, Framengo's legend, Zico, soccerstar Hulk and Cassio advertise Pixbet, Mateus Kunya, Rodinei, and Joan Gomez are active players. ・ I am an ambassador.

Other brands are trying to reach new viewers through influencers. Diogo Diffante, who has 3. 5 million followers on Instagram, has broadcast an adventure in the Catal World Cup for Estrelabet. CRAQUE NETO with 2. 9 million followers on Instagram has partnered with Bet7k.

17 of the Betting operators operated in Brazil are also sponsors of Serie A and Serie B in Serie B in Brazil. Of the 17 operators, 14 are licensed on the Island Island, and BETFAIR, Betano, and Novibet have a Malta license.

Naive gamblers have little legal protection

The large number of operators with a curl sawing license rarely give Better in Brazilian legal protection.

One of them, Itamar Mero, claims that Pixbet has not paid him:

"Pixbet is two bets I won, the first is 490 real, the second is not paid 543, 70 Real. I was not paid. I am Garbon, their ambassador. ・ Criticize Bueno.

The players of the game games described Pixbet as a rat lecture for the operator to move Better's funds, and whether there is enough pure gaming income for Pixbet to keep commercial promises. I'm wondering.

Senator Giorgi Kajuru of the Brazilian Socialist Party (PSB) has requested the Federal Police to investigate Pixvet.

"I've heard that Pixbet has made serious mistakes and crimes, but we can't judge without evidence," Kasuru commented.

What is a problem for many countries around the world, including Brazil, is that the explosive spread of Internet betting and the spread of smartphones have made it easier to bet and advertise.

"The market is immature, the general public is unknowing and separated from the gambling industry around the world," said Marcio Mansour, a 1 0-bet lawyer and former tax accountant.

"There are also operators that abuse this. They use the basic techniques that attract Betters with a welcome bonus. For Better in Brazil, the difference in the license between curaseau, Malta, and Man is hardly important."

Curaçao - a haven for unregulated betting companies

The Caribbean island of Curacao is at the center of this invasion of offshore betting operators flooding into countries where betting is illegal.

In Turkey, betting is only permitted in-country, but betting operators like superbahis. com and 1XBet are popular. Both have Curacao licenses.

In Morocco, 1XBet's full-page advertising led many to believe that betting on the website was legal until the government stepped in.

Curaçao's low taxes, easy access to the banking system, light regulation of online gambling sites, and opaque corporate structures are some of the reasons why it has become a haven for unregulated online gambling.

Curaçao is not the only source of these offshore operator licenses, but it is probably the largest.

Most of these offshore operator licenses have numerous mirror licenses that users can automatically access if the illegally operating site is shut down.

The Foundation for Representation of Victims of Online Gambling (SBGOK) estimates that, including mirror sites, Curacao-licensed operators are responsible for up to 20, 000 betting sites worldwide.

In the 2019 BBC podcast "How Gambling Interests Bought a Country," Curacao is portrayed as an outpost where lawyers allow offshore bookmakers to operate freely.

Mansour, 10BEt's legal adviser, said of Curacao:

Sublicenses blur the issue further

"It's very relaxed, both from a compliance point of view and from a responsible gambling point of view. You can do anything you want. Even a beginner without even the slightest knowledge of how to operate a sports bookie can do it from Curacao.

It's easy to get a gambling license in Curacao.

The problem is further complicated by so-called sublicenses.

Currently, four companies hold master licenses in Curacao: CEG, Antillephone, Gaming and e-Management. These master license holders issue sublicenses to B2C ("B to C") operators, even though there is no clear provision in Curacao's laws and regulations that allows the master license holders to use their gambling licenses in this way.

However, the sublicense system goes unchecked, and today there are hundreds of sublicenses, giving a semblance of legitimacy to thousands of websites.

These sublicenses also allow these betting operators to access the global financial system through little-known loopholes. Play the Game has obtained copies of contracts between Curacao-licensed betting operators and payment providers.

That little word "or" is key, as it allows these shady betting operators to enter into contracts that give them access to the global financial system with just a betting license.

The laws governing Curacao-licensed betting operators do not make them legal to place bets in other jurisdictions, and the lack of legality in other jurisdictions applies to sublicenses as well.

As sports betting becomes more globalized, it becomes harder for local gambling regulators and consumers to distinguish between legal and illegal betting online, explains Martin Purbrick of the Asian Horseracing Federation.

Betting operators owe bettors millions of euros

"Illegal betting operators often purchase licenses in jurisdictions that do not recognize legality outside of that jurisdiction, creating a grey area for consumers and regulators," explains Martin Purbrick of the Asian Horseracing Federation.

"The sublicensing issue suggests that such status gives operators the legal right to accept bets from consumers outside Asia, Europe or Curacao. Such a licensing regime is fundamentally flawed as it effectively encourages illegal betting in other countries," Purbrick said.

SBGOK is helping bettors with claims of non-payment by opaque betting operators, but weak laws and the mysterious nature of the corporate structures involved make it very difficult to hold operators accountable.

The foundation currently represents 175 people with claims of more than €12 million. So far, 52 people have been repaid €3. 1 million in unpaid winnings. Another 80 people are facing court cases on the island with €5. 5 million in unpaid winnings.

"There are an incredible number of unpaid people. This is just the tip of the iceberg," says SBGOK's Nahdi Krumm.

The failed attempt to change the laws in Curaçao

"We get bills every day. I'm sure it's 1, 000 times that because we're not marketing ourselves. It breaks my heart, but we have limited capacity and we have to go with the ones that have the best chance of success."

"The whole point of the Curacao license is to keep the funds under the radar using the sublicensing system, not to identify these people behind the companies. They feel invincible because the Curacao government doesn't know who they are. It's rotten to the core," says Krum.

Under pressure from the Netherlands, the Curacao government introduced a new gambling law in 2023 to bring it in line with international standards and reform the master license system.

The new law, abbreviated as LOK, is seen as a way to get more tax revenue for the government, but on the other hand it will increase control and oversight by the new national regulator, the Curacao Gaming Board (CGB), which will be solely responsible for issuing licenses.

Betting operators will need a minimum capital of 100, 000 euros, there will be increased player protections, and new rules for advertising online games.

In addition, the application must be accompanied by a personal declaration revealing the identity of the main stakeholders and the wealth of shareholders with more than 10% of the shares. The license includes strict conditions on anti-money laundering (AML) and responsible gaming.

But hopes are not high that the new law will solve all the problems.

"However, the situation is improving, and now even sublicensees must have a profile on the GCB site and comply with the conditions of use of the sublicense. In case of violation, they can lose the sublicense. The conditions of the sublicense, integrated into the local law, are quite substantial."

In a scathing editorial, the major news site Curaçao. nu questions the new regulations and predicts problems with implementation and enforcement as a major problem:

"The LOK contains provisions aimed at preventing crimes and protecting players, but the effectiveness of these measures depends on their implementation. It is precisely in this respect that there seems to be a lack of decisiveness and transparency. It seems that the director is doing things the way he has been doing them since 1996. "Not at all."

In January, the Curassau parliament rejected Lok's draft and called for a major revision. This was not surprising. In August, Curaceau's "RAAD VAN ADVIES" (Advisory Committee) has a major drawback of draft draft, such as lack of GCB's financial independence and compliance to recommendations from the global monitoring agency. Was emphasized.

When the reform of Curacaseau was about to realize, other countries, such as East Timor, Anjuan in Komoro, Laos, and Tobique in Canada, began to find the possibility of providing licensing.

The background was clear. The International Betting License market may have gaps that are rarely asked by operators.

For the time being, the reform of Curacasaw suggests that Curacao Island will continue to be one of the favorite areas of online offshore gambling, and as Purblick's "offshore licensing hayven". The company has purchased a license from a specific jurisdiction area, and promotes an illegal betting operator that claims to be a "license betting operator."

Brazilian reform may not stop dubious betting operators

Chris Chronau Rasmussen, the director in charge of governance consultant advice, adds: "They are just postponing their jobs to do something in 2030 or that. It's not a story. "

In Brazil, the law revision makes Curacaseau's licensing meaningless. At the end of 2023, President Lewis Inacio 'Lula' Da Silva, a new bill that legally legalized online sports betting and that offshore companies with licenses on the Kuraso Island can be operated in Brazil without any regulations or tax payments. Is passed.

The Rula and the administration believe that the law amendment is a means of obtaining tax revenue, and is questioning the preparation of the agency to execute and monitor the industry.

"In the four years under the Bolsonaro administration, the gambling worker has not paid billions of taxes, paying billions of taxes.

"I tried to be fair. I made 18 % taxes paid by the majority of Brazil, which are paid by the 27. 5 % tax deducted from salaries." < SPAN> In January, the Curaceau parliament rejected Lok's draft and called for significant corrections. Betting license: countries where bookmaker business is legal

"I tried to be fair. I made 18 % taxes paid by the majority of Brazil, which are paid by the 27. 5 % tax deducted from salaries."

Currently, Brazil's betting operators are taxed by 12 % of the total game income, and Better pays 15 % to pure victory. Better is subject to Brazil's Consumer Protection Law and Procon (Consumer Protection and Defense Organization's Complaints Mechanism).

How legal is online sports betting? Regulations and Rules

"This is not the only issue of tax," said Jose Francisco Mansour, a special adviser of Brazil Secretary of Finance.

"We deal with many problems that we have never handled before. There will be restrictions on problems such as addiction, responsible advertisements, and tools to compete with money laundering."

The biggest markets of the world: the UK, Australia, and the USA

The United States

The Brazilian government predicts that 40 to 80 bookmakers will operate in Japan. Within six months, the Ministry of Finance will set a Brazilian license standard. Currently, 134 companies want a license, including 1XBET, 1XBET, melbet, and OceanBet.

"Congress said it would protect the Brazil market.

Mansa avoided comments about the individual cases of 1XBET and added: "Entering the Brazil market is very severe).

United Kingdom

However, regulating the entry into the Brazilian market may not be able to prevent a dubious betting operator developing its business in Brazil. As with other lodgings, businesses may never be understood because the license's final beneficiaries can avoid ownership requirements by appointing a front office that scraped the government's due dudery.

"1XBET Brazil will find a reliable nomine with gambling experience in Russia, so you won't see the real owners of Ocean88 or 1XBET," says 10bet Mansur.

Australia

"Because 1XBET Brazil will find a trusted person with gambling experience in Russia," said 10bet Mansur.

In fact, the 1XBET operation method in Nigeria is like this, and local companies, Beaufort Bet, have obtained a license under their names and are working as franchises.

Law and order – sports betting in Europe

"It means that you have the source of wealth, the source of funds, and gambling experience.

"Betting operators say that this is a local partner and the owner of the company. Otherwise, who can say that it is very difficult for authorities. It cannot be moved based on guessing." 。

The new bill is obliged to gambling to report suspicious bets suggesting matchfixing. Brazil has been neglecting the fight against matchfix for so long. The Brazilian Football Federation (CBF) is a chronic crisis situation and considers this issue as a authority. Part of the new tax revenue will be paid to the Federal Police to eradicate matchfix.

According to SPORTRADAR data, 800 years in Brazil are one in the world. Sportradar is FIFA's "Integrity Partner" and also provides live data to the sports betting industry. Sportradar reported the data to the CBF, but the management organization did not work.

Volatility and opportunity – African countries

The ministry of sports and finance has already recommended SPORTRADAR as a sincere partner. According to the Ministry of Sports, Secretary of Sports, the ministry does not know that the Sport Radder plays a double role of a data collector and integrity monitor.

The online sports book is a highly profitable venture, and in 2023 the world's betting market was $ 89 billion. The status of regulations is complicated, especially for international businesses, but surviving it is worth the risk.

  • The definition of "gambling" and "betting" depends on the country where betting is legal. In addition, the legal taxable tax and license provision vary from country to country. Some European countries, such as Sweden and Hungary, still restrict gambling into a single monopoly by the government, but the problems are often the case that the EU guarantees and coexist with the freedom of services guaranteed by the EU. Is it possible? The EU does not clearly accuse these systems, but many of the Judicial Court's decisions are leaning on the liberalization of the betting market.

  • This site is an interesting book for morning coffee. As the attack on the "hidden junk" commission is attracting attention, it is necessary to examine the fact that there is no crackdown to regulate bots to buy tickets. Ticket brokers, including Stubhub (Stubhub), paid millions of dollars to buy tickets. When a ticket broker sells tickets for resale, STUBHUB and other fees will be r e-collected again by resale. Theoretically, a $ 100 ticket for an event resells a 50 % commission income. So why is the ticket sales platform prohibited from the use of brokers and the use of bots? #Ticketing #ticketingplatforms #Stubhub #ticketmaster #AXS
